Shipping Info

Interpretation

1.1 In these terms and conditions:

"Account" means the personalised account created by the Customer on the Website enabling the Order of Goods.

"Agreement" means these terms and conditions, including the terms of any Order placed by the Customer through the Website (if applicable).

"Business days" means business days in Brisbane, Australia.

"City Beach" means Fewstone Pty Ltd ACN 010 496 465 trading as City Beach.

"Customer" means any person or persons who wish to or have used the website to place an Order.

"Goods" means any products described in an Order and includes packaging.

"Intellectual Property" means all rights in patent, copyright, trade names, trademarks, logos, designs, images (including photographs, videos, multimedia or films) or service marks (in each case whether registered or registrable).

"Material" means any information (including but not limited to data, source codes, and drawings) or images in any form (whether visible or not) stored on or used in connection with the Website.

"Order" means a request submitted by the Customer to purchase Goods from City Beach through the Website.

"Restricted Material" means any product displayed for sale on the Website, the sale of which is restricted to persons of a certain age.

"Website" means the internet site located at www.citybeach.com.au operated by City Beach.

1.2 Any reference in this Agreement to the singular includes the plural, to any gender includes all genders, to any act or statute includes any act or statute which supersedes, replaces or modifies any earlier act or statute, to persons includes all bodies and associations both corporate and incorporated and vice versa, paragraph headings are for reference purposes only and all references to clauses are to clauses in this Agreement unless otherwise specified. All references to dollar amounts are references to Australian dollars.

General Information

2.1 The Customer must ensure that the Customer enters the correct delivery address as parcels which are returned to City Beach as undeliverable may incur a re-dispatch fee and will be sent back out as regular mail. Freight charges paid for the original dispatch are not refundable.

2.2 City Beach does not ship internationally.

2.3 Large orders and bulky items which include but are not limited to travel bags, surfboards, body boards and cruiser skateboards will/may be shipped with TNT couriers. These orders can not be sent to a PO Box address, it must be a residential or business address with business name included in order. You will be notified via email with your TNT tracking number. Please see below for shipping charges applied to bulky items.

The estimated delivery date depends on where the Customer lives, and is calculated from the time the Customer receives the 'Order Shipped' email, not from the time the order was placed.

The following are estimates only, and are based on information provided by TNT couriers:

Express road service - 3 to 10 business days for metro areas. Please allow up to another 10 business days for rural areas.

2.4 If the Goods are delivered by courier, the Customer's parcel will be delivered during normal business hours. Upon delivery, the Goods must be signed for. If a signature cannot be obtained at the time of delivery, a card will be left informing the Customer of how to collect the Customer's parcel during normal business hours. Parcels will be held by the delivery service for their maximum hold time. Should the Customer not respond to a calling card and the parcel is returned to City Beach as unclaimed, further freight charges may be payable for re-dispatch. Freight charges paid for the original dispatch are not refundable.

Once the Goods have arrived in City Beach's warehouse, it may take up to another 3 days for processing and dispatch. Once the Order has been shipped, the Customer will receive an email confirmation.

All Other Parcels and Products

2.5 Depending on the nature of the Goods ordered, City Beach will arrange for delivery of the Goods by Australia Post or a courier. City Beach will use its best endeavours to deliver the Goods to the Customer's nominated delivery address within the time period specified in point 2.6; however City Beach will not be liable to the Customer or anyone else for any losses suffered or incurred due to delay.

2.6 City Beach endeavours to process all orders within the next business day however please allow up to 3 business days for your order to be processed and dispatched.

2.7 For deliveries within Australia, the Customer should allow for standard Australia Post delivery times. The estimated delivery date depends on where the Customer lives, and is calculated from the time the Customer receives the 'Order Shipped' email and not from the time the Order was placed. The following are estimates only, and are based on information provided by Australia Post:

Standard mail - 2 to 6 business days for metro areas. Up to 10 business days for regional areas.
Express post - 1 to 2 business days for metro areas. Up to 4 business days for regional areas.

2.8 The Customer should allow for a further 3 business days (in addition to the above) for delivery to remote areas as an estimate only.

2.9 Delays may occur around Christmas, Easter and public holidays. Remote deliveries are subject to local transport schedules and may encounter extended delays. Please note that that there are limitations on all courier networks and some remote delivery addresses will not be serviced door-to-door. In these cases, the couriers will deliver to a local depot or Australia Post office and the customer will be contacted to collect from there. Some remote locations such as islands can only be accessed by boat therefore normal shipping times do not apply.

2.10 The delivery dates are estimates only. City Beach will do all that it can to ensure delivery within the estimated dates, but factors such as public holidays and peak delivery times may not allow this to always be possible. Please note that while Australia Post provides a reliable national service, delivery delays can occur for a variety of reasons. If you are experiencing a longer than usual delay, please first enquire about your missing package at your local post office.

2.11 If the Customer's Order cannot be dispatched within 3 business days of the Order being placed, the Customer has the opportunity to cancel the Order or modify the Order (in the event of lack of availability of particular Goods). To do so please contact our customer service team on 1800 640 811 or customerservice@citybeach.com.au

2.12 City Beach reserves the right not to accept an Order, or having accepted an Order, to cancel an Order if it cannot supply the Goods the subject of the Order.

2.13 City Beach Online cannot investigate dispatched missing orders until 10 business days after the customer has received the 'order shipped' email, as per Australia Post guidelines. If your package has still not arrived at this time please contact us on 1800 640 811. Any damaged or lost orders are subject to an investigation carried out by the courier service. This investigation can take up to 10 business days and we must allow the delivery company to complete their investigation before we can take any further action in to the where about of the parcel.

2.14 Australia post does not require a signature for delivery unless otherwise specified. Customers not in attendance when an order is delivered may find their parcel left at the residence in a safe spot i.e. letterbox or will receive a card with information on collection of the order. Australia Post does not redeliver items which have been transferred to a local post office for collection.

2.15 Special instructions can be left for delivery of your order during checkout, City Beach takes no responsibility in the case that these instructions are not followed.

2.16 If the customer leaves specific shipping instructions for a parcel to be left at a property then the parcel is left at the customers own risk. City Beach accepts no responsibility or damage or loss of parcels that have been left as per the shipping instructions.

Multiple Item Orders

3.1 Subject to the terms of any Order, if City Beach can not supply all items, you will be contacted and the rest of the order will be shipped.

3.2 Where size exceeds packaging restrictions the order may be sent in multiple parcels with multiple tracking numbers. Due to this the complete order may not arrive at the same time.

Shipping Charges

4.1 For all customers whose delivery address is within Australia, we have FREE Standard Shipping ($5.99) on orders $75.00 and over. A fee of $5.99 for regular shipping will be added to all orders placed under $75.00. Express shipping is available for $9.99.

4.2 Free shipping excludes Gift Card purchases and bulky items.

4.3 The Customer will be able to see the freight costs at the checkout stage, before finalising the Order payment.

4.4 If required by City Beach, the Customer must pay to City Beach the delivery fee (or such other fee as may be specified by City Beach) in respect of each Order.

4.5 If the Order includes Restricted Material in respect of which the law prescribes a minimum age to the purchase, the Customer must ensure that a person over the age of 18 years (or such other minimum age as is prescribed by the law) is available to accept delivery of these Goods.

Same Day Dispatch

5.1 We aim to dispatch all orders placed before 2pm AEST (weekdays) same day. If your order is placed after 2pm AEST, it will be dispatched the following working day.

5.2 Please note, where an order is placed before 2pm (weekdays) during a major promotional period or after a public holiday, there may be a delay on the date of dispatch due to the high volume of orders received.

5.3 City Beach utilizes Australia Post as our third party delivery service provider. The delivery times provided by us are estimates only and delays may sometimes occur beyond the control of City Beach. We take no responsibility for late deliveries or loss or damage relating to late deliveries by Australia Post, or any third party delivery services.

5.4 Please provide complete and accurate details at the time of making your purchase. You may be required to provide additional details upon our request to ensure the accuracy of your order, which may result in dispatch and delivery delays.

5.5 Please ensure you enter the correct delivery address. We cannot be held responsible for an incorrectly entered delivery address

5.6 Please note that you can track your order for an Estimated Time of Arrival from Australia Post website http://auspost.com.au/track

Bulky Shipping Charges

6.1 Charges do apply to items deemed to be of a bulky shipping nature. City Beach does reserve the right to change the charge values and the products they apply to without notification.

6.2 Where an order contains Items that are deemed to be bulky and regular items, the bulky Item charge will apply to the whole order and exclude it from any free shipping promotion.

6.3 Bulky fees are charged on a per item basis. So as the multiples of the items increase so too does the shipping charge.

6.4 Bulky items are not inclusive of any free shipping promotion.

Dangerous Goods

7.1 Please Note: Products which include but are not limited to perfumes, fragrances, cologne's & aerosols, are classed as Dangerous goods. We can only deliver to mainland Australia as all deliveries must travel via road freight. Dangerous goods (DGs) are items that can cause problems during transportation, i.e. explosive, flammable or corrosive. Safety regulations prohibit many DGs from being shipped by air. City Beach does not offer Express Delivery for parcels containing DGs as they may be air transported, however we can deliver them by Standard Delivery.

Damaged Deliveries

8.1 Subject to City Beach's return policy, City Beach will take all reasonable care to appropriately pack all Orders, but will not be liable or responsible for any damaged Goods or missing Orders.

Risk & Title in the Goods

9.1 Subject to payment, property and risk in the Goods passes to the Customer upon delivery of the Goods to the Customer's nominated delivery address. Anyone at the Customer's nominated delivery address who receives the Goods shall be presumed by City Beach to be authorised to receive the Goods.

Free Shipping

10.1 FREE Standard Shipping applies to orders $75 and over made within Australia, excluding gift card purchases & Bulky Items. Orders under $75 will incur a $5.99 fee for standard shipping. Express delivery is available with a fee of $9.99
